These Terms of Service ("Terms") govern your access to and use of GimmyClues, including the website at gimmyclues.com and the application at app.gimmyclues.com (together, the "Service"), operated by GimmyClues ("GimmyClues", "we", "us", or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

GimmyClues is an AI-powered platform that helps creators turn ideas into short-form video content. The Service may generate scripts and scenarios using large language models, produce narration audio, generate images and avatar-based video, and, where you choose to connect a third-party account, help you publish content directly to social media platforms such as Instagram, Facebook, YouTube, and LinkedIn.

2. Eligibility and Account Registration

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. You agree to provide accurate registration information, to keep your password confidential, and to notify us promptly of any unauthorized use of your account. You are responsible for all activity that occurs under your account.

3. Your Content and License to GimmyClues

"Your Content" means any idea, prompt, text, image, audio, or video you submit to or generate through the Service. You retain ownership of Your Content. By using the Service, you grant GimmyClues a limited, non-exclusive license to host, process, and transmit Your Content solely to operate, maintain, and improve the Service and to deliver the outputs you request, including publishing to a third-party platform you have explicitly connected and authorized.

You represent that you own or have the necessary rights to Your Content, and that Your Content does not infringe the rights of any third party or violate any applicable law.

4. AI-Generated Content Disclaimer

Scripts, scenarios, images, narration, and video produced through the Service are generated with the assistance of artificial intelligence and may contain inaccuracies. You are solely responsible for reviewing and editing any AI-generated output before publishing or otherwise using it, and for ensuring it complies with applicable law and with the policies of any platform where you choose to post it.

5. Connecting Third-Party Platforms (including Facebook and Instagram)

The Service allows you to voluntarily connect third-party accounts (such as Meta/Facebook, Instagram, YouTube, or LinkedIn) to publish content directly from GimmyClues. When you connect a third-party account:

• You authorize GimmyClues to access and use that account only to the extent of the permissions you grant during the connection process (for example, to publish a video on your behalf).
• Your use of the connected platform remains subject to that platform's own terms of service and policies, including Meta's Platform Terms and Developer Policies where Facebook or Instagram is involved.
• You may disconnect a connected account at any time from within the Service, which revokes GimmyClues' access to it going forward.
• Access tokens for connected accounts are encrypted at rest and used only to perform the actions you request.

6. Acceptable Use

You agree not to use the Service to create, store, or publish content that is unlawful, defamatory, fraudulent, or infringing; to impersonate any person or entity; to violate the intellectual property or privacy rights of others; to distribute malware or spam; or to attempt to gain unauthorized access to the Service or to any connected third-party platform.

7. Intellectual Property

The Service, including its software, design, and underlying technology, is owned by GimmyClues and protected by intellectual property laws. Except for the limited rights expressly granted to you in these Terms, no other rights are granted.

8. Subscription and Payments

Certain features of the Service may be offered under paid plans. If you purchase a paid plan, you agree to pay all applicable fees as described at the time of purchase. Fees are non-refundable except where required by law or expressly stated otherwise.

9. Termination

You may stop using the Service and request deletion of your account at any time by contacting us at info@gimmyclues.com. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service, in each case with notice where reasonably possible.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, GimmyClues will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to your use of the Service.

12. Governing Law

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict of law principles.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above. Your continued use of the Service after a change becomes effective constitutes acceptance of the revised Terms.
